Terms of Service

1. Who we are

Deploy ("Deploy", "we", "us") designs, builds and hosts websites for local businesses. These terms are an agreement between Deploy and the business that signs up for a plan ("you", "the client"). By completing checkout, you agree to these terms.

2. Plans and pricing

• Get Found: $99 per month plus a one time setup fee, with a 3 month minimum term. Includes up to 10 pages, mobile optimized design, hosting, backups, security and updates, a contact form and social links, online booking and payments integration, 1 professional email address and email support.
• Get Booked: $350 per month, no setup fee, with a 6 month minimum term. Includes everything in Get Found plus up to 25 pages, 2 professional email addresses, 2 hours of edits every month and priority email support.

Prices are in US dollars and shown at checkout. Third party costs such as your domain name (see section 9), booking software, payment processing fees and any paid email or app subscriptions are your own and are not included in the plan.

3. Billing

• Your plan is billed monthly in advance to the card on file, starting on the day you check out. The setup fee, where it applies, is charged at checkout.
• By checking out you authorize Deploy to charge your payment method each month for the plan you selected until the plan is cancelled.
• If a payment fails we will retry it. If it is not paid within 14 days we may pause your website until the balance is settled.
• Setup fees are non refundable once work on your site has started.

4. Minimum term and cancellation

• Get Found has a 3 month minimum and Get Booked has a 6 month minimum, counted from your first payment.
• After the minimum, you can cancel at any time by emailing info@deploymade.com with 30 days notice. You will not be charged for any month after your final billing date.
• If you cancel before the minimum term ends, the remaining months of the minimum are due at the time of cancellation.
• We may end the agreement with 30 days notice, or immediately if payments are 30 or more days late or the site is used for anything illegal or harmful.

5. Build process and approval

• We design your homepage first. If you do not love the homepage design you can walk away before checkout and owe nothing.
• Your site goes live within 7 days of us receiving your logo, photos, business details and any other content we ask for. Delays in sending content push the launch date back.
• You are responsible for reviewing the site and approving it before launch. Once approved, further changes count as edits under your plan.

6. Edits and support

• Get Booked includes 2 hours of edits each month. Unused hours do not roll over.
• Get Found edits are billed by the hour at our current rate, quoted before the work is done.
• Edits mean text, image and small layout changes to existing pages. New pages beyond your plan limit, redesigns and new features are quoted separately.
• Support is by email at info@deploymade.com. We aim to reply within one business day.

7. Your content

• You confirm that you own or have permission to use everything you give us (logo, photos, text, reviews) and that it does not infringe anyone else's rights.
• You keep ownership of your content. You give Deploy permission to use it to build, host and promote your site, and to show your site in our portfolio unless you ask us not to.

8. Ownership of the website

• While you are on a plan, Deploy owns the website design, code and templates, and you have a license to use the site for your business.
• After 12 months of continuous paid service, the website is yours to keep. We will provide the site files on request so you can host it anywhere, or you can stay on your plan and we keep hosting and maintaining it.
• If you leave before 12 months, the site is taken down at the end of your final billing period. We can provide your content back to you on request.

9. Your domain name

• If you already have a domain, you keep it. You give us access to point it at your new site, and nothing about its ownership changes.
• If you do not have a domain, we can purchase one for you. We register it in your business name with your contact details, so it is yours from day one, not ours.
• Domain prices change according to market price. We will advise you on the current price before purchasing and will only proceed if you agree. You can always purchase a domain yourself.
• The domain is always yours, whether you stay with Deploy or not. If you leave, we will transfer it to a registrar account of your choosing on request at no charge.
• We never hold a domain hostage. If a renewal payment is missed we will remind you before it lapses, but keeping the renewal paid is your responsibility.

10. Hosting, uptime and security

We host, back up, update and secure your site as part of your plan. We work hard to keep it online but cannot promise it will never be down. We are not responsible for outages caused by third party hosting, domain or email providers, or by changes you make yourself.

11. Results

We build sites to help you get found and get booked, but we do not guarantee any specific number of visitors, calls, bookings or sales, or any particular ranking on Google.

12. Limitation of liability

To the extent allowed by law, Deploy's total liability to you for anything related to these terms or your site is limited to the amount you paid us in the 3 months before the claim. We are not liable for lost profits, lost business or indirect damages.

13. Changes to these terms

We may update these terms from time to time. If we make a change that affects your plan or pricing, we will email you at least 30 days before it takes effect.

14. Governing law

These terms are governed by the laws of the State of New York. Any dispute will be handled in the courts of Suffolk County, New York.
